DA reviewing case involving off-duty policeman
OCEANSIDE -- A veteran Oceanside police officer was arrested on suspicion of felony drunken driving in early June after rolling his personal truck while off duty, injuring himself and a passenger, the North County Times has learned.
"We have not filed charges, but the case has been submitted to our office for review," Paul Levikow, spokesman for the district attorney's office confirmed Wednesday.
The driver, Officer Dwight Carwell, a 15-year employee of the Oceanside Police Department, has been reassigned to administrative duties at a desk during the review, department spokesman Sgt. Kelan Poorman said Tuesday.
"It's in the judicial process," Poorman said. "There is no discipline that has been handed out at this time."
The accident occurred around 2 a.m. June 7, according to California Highway Patrol spokesman Brad Baehr.
Carwell, then 46, was driving northbound on Interstate 5 with a 40-year-old male passenger when he lost control of his 2006 Nissan Titan about 1.2 miles south of Via de la Valle in Del Mar, Baehr said Wednesday.
The truck left the freeway and overturned, Baehr said.
Carwell told the Highway Patrol that he had been cut off, but no other car was identified, Baehr said.
Carwell was arrested on suspicion of felony driving under the influence and released to a hospital for treatment. In California, drunken driving can be a felony if another person is injured.
Both Carwell and his passenger were transported to Scripps Memorial Hospital La Jolla. Baehr declined to identify the passenger.
Baehr said Carwell was tested for alcohol, but he declined to give exact results.
"I can tell you it was over 0.08," the legal limit in California, he said.
Carwell, a former San Diego County Sheriff's Department corrections deputy and corporal in the U.S. Marine Corps, did not return a call seeking comment Wednesday.
Asked if Carwell had every been involved in similar incidents in the past, Poorman replied: "Not that I'm aware of."
