Anti-immigration activist charged

SAN DIEGO ---- An anti-immigration activist has been charged with battery, interfering with the civil rights of two day laborers, and filing a false police report, City Attorney Michael Aguirre announced Monday.

A total of nine charges against John Matthew Monti, 36, stem from a Nov. 18 incident near Rancho Penasquitos Boulevard, at a site where day laborers gather to find jobs, Aguirre said in a written statement.

Monti, who could not immediately be reached for comment Monday, has claimed he was the one who was attacked, claims that have appeared on a number of Web sites of groups opposed to illegal immigration.

The Los Angeles-area resident is scheduled to appear in court April 13 on four counts each of battery and interference with civil rights and one count of filing a false crime report to a peace officer.

Monti has said he is a member of the anti-immigration group Save Our State; the city attorney's office said in its written statement that Monti is affiliated with the border-watch group known as the Minutemen.

According to the city attorney's office, Monti began taking photographs of the workers while calling them "Mexicano Cochinos," or dirty Mexicans.

He allegedly began punching one of the victims, Estanislao Gonzales, who tried to walk away because the defendant was sticking his camera in the man's face, according to prosecutors.

When Roberto Pena tried to help Gonzales, who is described in court papers as being disabled, he, too, was assaulted by Monti, prosecutors allege.

Immediately afterward, Monti contacted police, claiming he had been robbed and assaulted by six to eight migrant workers, Aguirre said.

In a telephone interview with the North County Times in November, Monti alleged that he was at the site to photograph day laborers being picked up for work when he was attacked from behind.

In that interview, Monti said his camera and cell phone were taken in the alleged attack, but that he recovered them.

In March, Monti filed a complaint with the San Diego County grand jury for what he described as a failure by authorities to adequately respond to an unrelated incident of prostitution and human trafficking in migrant camps near McGonigle Canyon, an area where hundreds of migrant workers were evicted last year.

Then the city attorney Mr. Michael Aguirre (Latino)also charges him with filing a false crime report. Illegals have more rights than citizens. They can get free handouts that are own citizens need but can't get. Some of are leaders are trying to reward those that have broken laws by voting for amnesty for 12 million that a majority of, would become even more eligible for free benefits, and social security.(As like there is enough social security for me when I qualify.) Shoot if they drive drunk, and kill someone they can just go back to Mexico, or where ever they may be from. Even are own border patrol go to prison longer than some murders do for shooting an illegal in the side of the buttocks. They where senteced to 11, and 12 years each, while this illegal who was shot in the buttocks had already been convicted for smuggling was prisoned, and deported. He was already here illegally that time too. Since then he has a civil lawsuit against the B.P. for 5 million,(a lawsuit he will probably win) and has been arrested for a 3rd time with smuggling. All three times he had reportly had 100's of pounds of drugs. Oh yea since the agents shot him in the butt he was given amnesty for his crime of smuggling, as well with citizenship, and we the taxpayer will pay for him, his family, and all his future family for generations to come. Goes to show that crime does pay in America as long as you are illegal. Maybe I should go south of the border hop the border, and create a new identity so I can get out of some old hospital bills from 4 years ago when I was only able to afford health insurance for my kids. Lets stop the madness people, and it doesn't matter wheater you are bronw, white,black, or whatever. God bless America, not illegal activties!!!!!

Please I hope this guy gets what he deserves. This type of behavior is disgusting and I am appauled that grown men are doing this type of thing. We have zero tolerance for violence in our schools and her we have this happening on our streets. We need to have zero tolerance in our streets to avoid this type of thing from happening again. NO it is not okay to attack, vandalize, demean, and hurt people no matter what their current immigration status is or what you preceive their current immigration status is. From identity theft to driving unlicensed and without insurance to multiple DUIs where they just get a warning and a release until they finally kill someone like Any Kortlang or Tyler Londin. Statistics from Texas show that illegals get arrested 6 times before the feds will get up off their lazy asses and deport them. I smell a set-up, and I suspect this man Monti is innocent.

Fox New 6 captured the attack on video. Equal protection is not equal if if is not applied equally. Do a search for the video. Then lecture about equal protection.

This is in response to a long line of trying to silence the anti-illegal crowd. It's NOT going to work. It will make us stronger. Where's the SDPD when all the video of attacks happen and they somehow don't feel like pressing charges? Pictures of John's injuries are evident, yet after his complaint goes in against the SDPD, then they decide an illegal's word against him is enough evidence to charge him. How does Claudia Smith, an activist know about charges being filed almost two weeks, announce it on national tv, before the person they are filed on? Sounds fishy to me. ALL people are liable to present identification when demanded by authorities...so if the "day laborers" were no able to present documentation, why was not ICE called? Of course I know the answer to that also -- San Diego is a "sanctuary city" that will not permit police to ask for citizenship documentation...so IF the "day laborers" were illegal (which is to say they had broken a federal law, local police will not enforce THAT federal law, whereas they would enforce other federal laws. Selective enforcement.
